Terms of Service

1. Agreement to Terms

By accessing or using TowMeUp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by TowMeUp LLC ("TowMeUp," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of TowMeUp, including pilots, park operators, instructors, tug pilots, ground crew, and any other person who accesses the platform.

2. Description of Service

TowMeUp is a flight park management platform that provides digital ticket sales, online check-in, USHPA membership validation, queue management, and related tools for aerotow hang gliding and paragliding parks. Access to specific features depends on your role (pilot, instructor, park operator, etc.) as configured by your park.

3. Accounts

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@towmeup.app if you believe your account has been compromised.

You must be at least 13 years of age to create an account. Minors under 18 must have a parent or guardian complete bookings and any required waivers on their behalf.

4. Payments and Refunds

Flight ticket purchases are processed through Stripe on behalf of the park where you are booking. Payment terms, pricing, and refund policies for individual flights are set by each park operator, not by TowMeUp. Contact your park directly for refund requests.

TowMeUp collects a small platform fee on each transaction. This fee is non-refundable. By completing a purchase, you authorize the charge to your payment method.

5. Safety and Assumption of Risk

Hang gliding and paragliding are inherently dangerous activities that involve risk of serious injury or death. TowMeUp provides software tools only. We do not operate any flight park, employ any instructor or tug pilot, certify any pilot, or control any aspect of flight operations. All safety decisions are the responsibility of the park operator, the pilot, and the pilot's instructor.

Weight limits, USHPA membership requirements, and other safety gates enforced by TowMeUp are provided as a convenience only. The park operator and pilot retain full responsibility for verifying eligibility and fitness to fly.

6. Accurate Information

You agree to provide accurate information including your body weight when required. Providing false weight or other safety-relevant information may endanger yourself and others, and may result in account suspension.

7. Park Operators

If you use TowMeUp as a park operator or on behalf of a park, you agree to: (a) operate the platform in compliance with applicable law; (b) maintain accurate park, staff, and pricing information; (c) honor bookings made through the platform; and (d) ensure that your use of pilot data complies with our Privacy Policy.

Park operators are responsible for compliance with all applicable consumer protection, aviation, and safety regulations in their jurisdiction.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to access accounts, data, or systems you are not authorized to access.
  • Interfere with or disrupt the Service or its infrastructure.
  • Scrape, copy, or redistribute data from the Service without written permission.
  • Impersonate another person or misrepresent your affiliation with any park or organization.
  • Use automated systems (bots, scrapers) to access the Service without our prior consent.

9. SMS Messaging Terms (TowMeUp Flight Alerts)

TowMeUp Flight Alerts is an optional SMS program that sends daily flying coordination polls, flight condition updates, and condition rating requests to pilots who have opted in through the TowMeUp app. Message frequency: 1–2 messages per day. Message and data rates may apply.

Reply STOP to cancel at any time. Reply HELP for help. You may also opt out in your Alert Settings panel or by emailing hello@towmeup.app.

Consent to receive SMS messages is not a condition of using TowMeUp or purchasing any service. Carriers are not liable for any delayed or undelivered messages. For details on how your phone number is handled, see our Privacy Policy and the SMS Program page. For support, contact hello@towmeup.app.

10. Intellectual Property

The TowMeUp platform, including its code, design, logos, and content, is owned by TowMeUp LLC and protected by applicable intellectual property law. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding without written permission.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWMEUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TOWMEUP IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold harmless TowMeUp LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us at hello@towmeup.app. Sections 10–13 survive termination.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Georgia.

16. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
